1. INTRODUCTORY PROVISIONS

1.1 These General Terms and Conditions of Motel Grádo s.r.o., with its registered office at Mezi Lány 504/15, 158 00 Praha 5, identification number 04230515 (hereinafter the "Seller"), govern the mutual rights and obligations of the parties arising out of or in connection with the Purchase Contract ("Purchase Agreement") concluded between the Seller and a private person or company (the "Client") through the use of the website of the motelgrado.eu for the online accomodation booking in the Motel Grádo at Mezi Lány 504/15, Praha 5 (hereinafter the "Motel"). The e-shop is operated by the Seller via the motelgrado.eu web site via the web interface (the "Websites").

2. ORDERING OF STAYS

2.1 You can order a stay at the Motel by phone, in writing (by post, fax, e-mail) or filling in and submitting the form on the Website.

2.2 The order of stay is accepted by a written confirmation from the Seller. Reservation and order of the stay can be accepted and confirmed by processing the payment of the deposit. If the service is not used, the Seller will be charged the cancellation fee.

2.3 Online booking is binding. For a range of contracted services and prices is bound by the listing in the booking confirmation.

3. BINDING RESERVATION

3.1 A binding reservation means an obligation of the Seller to reserve for the Client the agreed number of accommodation places for the agreed dates and also the obligation of the accommodated person to use or, if necessary, to pay the cancellation fee to the Seller in the event that Client cancels the order or makes use of its binding reservation only in part.

3.2 In case of a binding reservation, the accommodation provider may require advance payment of the deposit of 100% of the total price.

3.3 Cancellation fees represent compensation for damage caused to the Seller by cancellation of a binding reservation and are:
- cancelation of the reservation more than 48 hours before the check-in date: 0% (free of charge)
- in the period prior to the day of arrival and on the day of arrival: the price of the first night
- from the day following the day of arrival: 100% of the deposit
The Seller will return the deposit reduced by the cancellation fee within 7 days after the written notification of the Client about cancellation of the binding reservation on the last day of the prematurely terminated stay.

4. PAYMENT TERMS

4.1 Client can pay the cost of the accommodation at the reception of the Motel on arrival by cash or credit card (Visa, Mastercard).

4.2 The cost of the accomodation (pre-payment) may be paid by the client before arrival using the instructions sent the Seller to the Client after booking the accommodation. The deposit can be paid:
- by card (Visa, Mastercard)
- bank transfer
- by the Bitcoin virtual currency
The advance payment (using any payment method) must be completed till the day of arrival (before check-in).

In the case of Bitcoin payment, the payment must be made within 24 hours of sending an email request for payment. If the payment is not confirmed within this deadline (6 Bitcoins confirmation is required), the reservation can be canceled.

4.3 The price includes fees (accommodation fee, city fee, taxes etc.), which are collected in the amount imposed by a competent government and city authorities.

4.4 A discount of 5% of basic prices can be applied by the Client only if all of the following conditions are met:
- Client booked accommodation at the Motel directly through the Motel Website,
- Client did not use any other reservation system (eg Booking.com),
- Client paid the full cost of the stay before the scheduled start date of the stay.

4.5 Seller is not a payer of the VAT.

5. RIGHTS AND OBLIGATIONS OF THE CLIENT

5.1 By concluding an accommodation agreement, the client acquires the right to the normal use of the leased room, the facilities of the accommodation company, which can be used by guests regularly and without special conditions, and for regular service. The client must apply his rights in accordance with any hotel guidelines or guest regulations (house rules).

5.2 Client has the right to complain about any deficiencies in the provided services. The claim must be filed without undue delay, so that the remedy can be arranged, if possible on the spot itself. Application will allow the removal of the defect immediately, while it becomes more difficult, with time, to assess the objectivity of the assessment and to handle the complaint properly.

5.3 Client is obliged to pay the agreed price at the latest at the time of departure. This includes any additional costs incurred due to the special services requested by himself or by the accompanying guests.

5.4 Client guarantees to the property owner for any damage caused by himself or by the guest or other person who, with the knowledge or the will of the client, use the services of the property owner.

6. RIGHTS AND OBLIGATIONS OF THE SELLER

6.1 The Seller is obliged to provide agreed services to the extent appropriate to its standard.

6.2 'In the event that the commencement of the stay does not commence until 10:00 on the day following the agreed day of arrival, the Seller will attempt to contact the Client by telephone to determine whether the Client continues to be interested in the service. If the Client is not reachable, the reservation can be canceled. In this case, the Client is obliged to pay the Seller the first night''s cost. If the price of the stay was covered by a deposit, the Seller may charge up to 100% of the deposit in this case.'

7. CHANGES OF SERVICES

7.1 Services offered in the motel may change during the year. The client is obliged to follow the current offer of services.

7.2 For unused ordered services and for changes in ordered services during the stay (accommodation, meals) the Seller does not provide any financial compensation

8. FINAL CLAUSES

8.1 The General Terms and Conditions will enter into force on December 1, 2017. Changes and additions to these Terms and Conditions may only be made individually between the Seller and the Client in writing.

8.2 Client‘s personal data mentioned in the order of stay will be used by the Seller only for the contractual relation ship between the Seller and the client.
